1. Introduction

These Terms and Conditions (“Terms”) govern your access to and use of the TapNaira mobile application, website, wallet, payment, bill payment, airtime, data, transfer, KYC, account tier upgrade, and other services provided by TapNaira Ltd.

By creating an account or using TapNaira, you agree to these Terms. If you do not agree, do not use the app.

2. Eligibility

To use TapNaira, you must:

  1. Be at least 18 years old.
  2. Provide accurate and complete registration information.
  3. Own or have lawful access to the phone number and email used for registration.
  4. Comply with all applicable Nigerian laws and regulations.
  5. Not be restricted, sanctioned, fraudulent, or prohibited from using financial services.

3. Account Registration

You agree to provide accurate information during signup, KYC, and tier upgrade.

You are responsible for keeping your phone number, email, password, PIN, OTP, and device secure.

You must notify TapNaira immediately if you suspect unauthorized access to your account.

TapNaira may reject, suspend, restrict, or close an account where information is false, incomplete, suspicious, fraudulent, or required by law/regulation.

4. KYC and Account Verification

TapNaira may require you to complete KYC before accessing some services.

KYC may include your name, phone number, email, address, date of birth, occupation, BVN, NIN, government ID, selfie/liveness check, proof of address, and other information required for compliance.

Submitting KYC does not automatically upgrade your account tier. You may need to separately request a tier upgrade and provide the required documents for that tier.

5. Account Tiers and Limits

TapNaira may operate account tiers with different transaction limits and requirements.

Current tier requirements may include:

Tier 0: Basic account after onboarding or KYC review stage.
Tier 1: Liveness selfie and government ID.
Tier 2: BVN.
Tier 3: Proof of address.

TapNaira may change tier requirements, limits, or approval rules to comply with law, regulatory instructions, partner-bank requirements, fraud controls, or business rules.

A tier upgrade may be approved, rejected, delayed, or reversed if information is incomplete, inaccurate, suspicious, or unverifiable.

6. Wallet, Transfers, Bills, Airtime, and Data

You may use TapNaira to fund your wallet, transfer funds, pay bills, buy airtime/data, and use other supported services.

You are responsible for confirming transaction details before submitting. This includes recipient account number, bank, phone number, biller, meter number, smartcard number, amount, and narration.

TapNaira is not responsible for losses caused by wrong recipient details, wrong biller details, wrong phone numbers, or mistakes entered by you.

Some transactions may be delayed, reversed, failed, or pending due to bank network issues, payment processor downtime, telco/biller issues, compliance checks, or other reasons outside TapNaira’s direct control.

7. Fees and Charges

TapNaira may charge fees for transfers, withdrawals, bill payments, wallet funding, reversals, or other services.

Fees will be displayed in the app where applicable before you confirm a transaction.

Charges may change from time to time based on service provider costs, banking/payment partner rules, CBN-approved charges, or business updates. The CBN Guide to Charges is intended to promote transparency and applies to regulated financial institutions in Nigeria.

8. Transaction Reversals and Refunds

Failed transactions may be reversed after confirmation from the relevant bank, payment processor, telco, biller, or service provider.

Refund timelines may vary depending on the provider and settlement process.

TapNaira may not refund a successful transaction sent to the wrong recipient, wrong phone number, wrong biller, or wrong customer reference supplied by you.

Where a reversal or dispute is valid, TapNaira will work with relevant partners to resolve it.

9. User Responsibilities

You agree not to:

  1. Use TapNaira for fraud, scam, money laundering, terrorism financing, illegal gambling, stolen funds, or unlawful activity.
  2. Provide false KYC information or fake documents.
  3. Use another person’s identity, BVN, NIN, card, bank account, phone number, or device without permission.
  4. Attempt to hack, reverse engineer, overload, disrupt, or bypass TapNaira security.
  5. Sell, rent, transfer, or share your TapNaira account.
  6. Use TapNaira in a way that violates law, regulation, partner rules, or these Terms.

10. Account Restrictions, Suspension, and Closure

TapNaira may restrict, suspend, freeze, or close your account where:

  1. We suspect fraud, unauthorized access, money laundering, terrorism financing, or illegal activity.
  2. Your KYC information is false, incomplete, expired, unverifiable, or suspicious.
  3. Required by law, court order, regulator, law enforcement, banking partner, or payment partner.
  4. You breach these Terms.
  5. Your account creates security, operational, compliance, or reputational risk.

Where allowed, we may notify you of the reason. In some cases, we may be legally restricted from giving full details.

11. Complaints and Dispute Resolution

If you have a complaint, contact TapNaira support through the app or email tapnaira01@gmail.com.

Please include your name, phone number, transaction reference, amount, date, and clear description of the issue.

TapNaira will review complaints fairly and work to resolve them within a reasonable time.

Where the issue involves a third-party provider, bank, payment processor, telco, or biller, resolution may depend on their confirmation and response.

CBN consumer protection rules emphasize fair treatment, transparency, and complaint redress mechanisms for regulated financial services.

12. Privacy and Data Protection

Your use of TapNaira is also governed by our Privacy Policy.

By using TapNaira, you agree that we may collect, process, store, verify, and share your data as described in the Privacy Policy and as required for KYC, AML, fraud prevention, transaction processing, support, and regulatory compliance.

13. Service Availability

TapNaira will try to keep services available, but we do not guarantee uninterrupted access.

Services may be unavailable due to maintenance, internet failure, bank downtime, payment processor issues, telco/biller downtime, regulatory action, security incidents, or events outside our control.

14. Limitation of Liability

To the maximum extent allowed by law, TapNaira will not be liable for indirect, incidental, special, punitive, or consequential losses.

TapNaira will not be responsible for losses caused by:

  1. Wrong information entered by you.
  2. Sharing your PIN, OTP, password, or device access.
  3. Fraud by third parties where you contributed by negligence.
  4. Network downtime or third-party service failure.
  5. Regulatory restrictions or force majeure events.
  6. Unauthorized transactions caused by your failure to secure your account.

Nothing in these Terms excludes liability that cannot be excluded under applicable law.

15. Intellectual Property

All TapNaira logos, designs, software, content, trademarks, graphics, and app features belong to TapNaira or its licensors.

You may not copy, modify, reproduce, sell, or misuse any part of TapNaira without written permission.

16. Updates to the App and Terms

TapNaira may update the app, services, fees, limits, requirements, Privacy Policy, and these Terms from time to time.

We may notify you through the app, email, SMS, or other reasonable means.

Your continued use of TapNaira after changes means you accept the updated Terms.

17. Governing Law

These Terms are governed by the laws of the Federal Republic of Nigeria.

Any dispute will first be handled through TapNaira’s internal complaint process. If unresolved, it may be escalated to the appropriate regulator, competent authority, or court in Nigeria.
